Enugu state high court presided over by Justice Odugu has set aside the the purported impeachment of the former deputy governor of Enugu state His Excellency Sunday Onyeabuchi.
The court based its decision on the fact that the allegations upon which the house of assembly carried out the impeachment do not constitute gross misconduct and that the sitting of the impeachment panel in camera violets the principle of fair hearing.
The court therefore reinstated mr Onyeabuchi to complete his tenure which ended may 29th 2015 and also ordered that his salaries, allowances and other entitlements including his pension as former deputy governor be paid.
The court however ruled that the nomination and approval of his replacement mr Ifeanyi Nwoye was illegal and therefore null and void.
The court also awarded the cost of 600,000 in Favour of mr Onyebuchi
