Abuja Court Strikes Out Case Against Lebanese Terrorist Suspects

A Chief Magistrate Court sitting in Karu, a suburb of Abuja has struck out the case of alleged terrorism and illegal importation of firearms leveled against four Lebanese nationals, Mustapha Fawaz, Talal Roda, Abdulla Tahini and Kossay Nourdin.

At the resumed trial, the prosecuting counsel, Cliff Osagie, in his application to withdraw the charges, told the court that further investigation against the accused persons revealed that the offences for which they were charged before the court are clearly outside the scope and jurisdiction of the court.

Lawyer to the accused persons, Ahmed Raji in his response informed the court that he had already filed a preliminary objection challenging the jurisdiction of the court to entertain the case and therefore will not object to the application for withdrawal of the charges filed by the prosecutor.

Having listened to both parties, Magistrate Muyiwa Oyeyipo granted the prayer of the prosecutor and struck out the case against the four accused persons who were subsequently discharged.

The men are suspected of having links to the Islamist militant group Hezbollah with terrorism and possession of illegal arms, after authorities said they found heavy weapons in one of their homes.

  15. Matters of terrorism and illegal possesion of fire arms are not within d jurisdiction of a magistraite court hence d court has d powers 2strike out d matter, dat dosen't in anyway mean dat d judge has taken bribe. What d prosecution will do is to file the same charges against dem at d Federal High Court bcox dat is d court dat has jurisdiction 4 matters of dis magnitude

  18. I would have ignored your vociferous and malicious tantroms but, it would necessary that in the nigerian legal system such a case termed as felony should not have been taking to a lower court, due to the security situation in the country. They deliberately sent the case to a lower court after collecting money knowing the fact that the case would end up in this way. If the president had called the IG and the CP in order things would have worked for the triumph of justice. Come to think of it is common men like me and you that suffer the security breach. Kindly be mature and don't try to force your blured opinion on others. Obasi JNR
